The privacy rule in HIPPA’s provision governs the handling and disclosure of client’s Protected Health Information by health-care providers. According to the American Psychology Association (2003), protected health information is defined as personal identifiable medical information that relates to the payment of care, provision of healthcare or the patient’s condition and all states have privacy laws already in place for such information. An individual’s right for health records privacy is recognized and such records remain a property of the health facility maintaining them. It is only when required or permitted by the state laws or other provisions that health information can be disclosed (e.g. following a subpoena). However, the broad standard applies that the law of the state takes precedence over HIPAA if it offers more protection to the patient and conversely, HIPPA take over when the state law is less stringent (American Psychology Association, 2003 ). Under the guidelines of HIPAA, the longest time one should wait before getting medical coverage for a pre-existing condition should not exceed twelve months and eighteen months for late enrollees. However, HIPAA also makes another provision for individuals switching from one group insurance job to another without interruption.
